NZIBS trademark

This is a "collective mark"

The Intellectual Property Office defines the term as follows:
"A collective association may register its trade mark as a collective trade mark in order to distinguish the goods produced or services provided by the members of the association from those of non-members, rather than those originating from a particular proprietor."

This mark is registered in two different classes:

  • Class 37: Construction services and advice and consultancy services in relation to building
  • Class 42: Building and dwelling surveys

Key points to remember

  • The mark is only to be used by a paid up, Registered Member.
  • This does not include student or transitional members.
  • Legal entities involving more than one person, such as companies and partnerships may NOT use the mark because:
    • Only individuals can be members
    • Only individuals can use the mark

This means it must not appear on company letterhead, even if the member's name appears in that letterhead.

The use of the mark is to distinguish a member from a non-member.

As such, the appropriate place to use it is alongside a member's name e.g. at the end of a report, after your signature:

Kojak Sylversteen, Registered Building Surveyor

The more the mark is used and becomes recognised, the better we will stand out as individuals, distinctly different from the rest of the market.
